Terms and Conditions and Counselling Agreement

Section 1 -- Subject Matter of the Agreement
The client engages the counsellor for psychological counselling services. The client and counsellor may jointly define the focus of the counselling. The collaborative work comprises one or more sessions, depending on the booking, and may also include other methods such as relaxation techniques (e.g. progressive muscle relaxation) to enhance sensory, mental and/or physical awareness.
The counselling addresses, among other things, anger management, emotional processing, mental and physical relaxation, personal development, resource activation and goal setting, stress management, grief processing, as well as coping with all types of psychosocial crises and/or challenges.
Counselling sessions are conducted exclusively online via video call or by telephone. The preferred language for counselling is German; however, sessions in English are available upon request and by prior arrangement.
The services provided do not involve the diagnosis, cure or alleviation of conditions with clinical significance, nor the treatment of mental disorders. Instead, the focus is on managing and overcoming emotional, mental or social conflicts, as well as other purposes outside the scope of medical practice (cf. German Psychotherapy Act, Section 1(3), sentence 3).
Section 2 -- Sessions, Packages, Location, Fees and Payment Terms
A counselling session typically lasts 60 minutes. There are three different types of 60-minute sessions. The higher-priced session is generally for coaching, followed by couples counselling. The lower-priced 60-minute session is generally for individual counselling. When two 60-minute sessions are combined, this results in a double session of approximately 120 minutes. The specified times and prices in the price list also apply to packages.
The fees are EUR 170 for a 60-minute individual session, EUR 185 for a 60-minute couples session, and EUR 200 for a coaching session. Package prices are available on the website and are subject to change. All fees are inclusive of VAT. The same fees apply for appointments after 5:00 pm or at weekends. The fees for the initial consultation and the concluding session each correspond to 100% of the standard session fee.
Fees are payable in advance.
Booked services (packages, individual sessions, coaching or couples counselling) are valid for a period of six (6) months. The period begins on the date of the binding booking. After the expiry of six months, any services not yet used shall lapse without replacement.
Counselling is conducted exclusively via video call or by telephone. Sessions must be booked by the client exclusively through the appointment calendar on the website SallySchulze.de or by arrangement with Sally Schulze. After each booking, the client will receive an invoice by email. If the client does not receive the invoice immediately after booking, the counsellor may, at her discretion, issue a new invoice; however, this is not obligatory. The available payment methods correspond to those currently indicated as available on the website SallySchulze.de.
The client should note that the costs of psychological counselling are not covered by statutory health insurance.
Section 3 -- Counselling Outcomes
The counsellor cannot guarantee that the client will achieve the desired outcome or any goals set during the collaborative work. Nevertheless, both parties shall endeavour to the best of their knowledge and using all available means and skills to promote the success of the counselling. The definition of goals, the selection of topics for discussion and the implementation of the solutions developed are the responsibility of the client.
Section 4 -- Duration of Counselling
The duration of the counselling depends on the number of sessions booked. However, in order to pursue specific goals, it is recommended that counselling sessions be conducted over several sessions (see also Section 2 -- Sessions, Location, Fees, Payment Terms).
Section 5 -- Termination
The counselling agreement may be terminated up to 48 hours before the next session. If termination occurs during a session, the session fee remains payable in full.
Section 6 -- Appointments, Lateness and Cancellations
Appointments are scheduled and booked independently by the client via the website SallySchulze.de or by arrangement with the counsellor. If the client arrives late for a scheduled appointment, the session time will be reduced accordingly.
Booked appointments are fixed appointments reserved exclusively for the client. If the client fails to attend a scheduled appointment without timely cancellation, the client shall owe the counsellor 75% of the agreed fee for that session.
This payment obligation does not apply if the appointment was cancelled at least 48 hours in advance, or if it had to be cancelled at short notice due to a serious event. In the latter case, the client should inform the counsellor of the impediment as early as possible and provide appropriate evidence if necessary.
If the client is unable to attend a scheduled appointment, the client must notify the practice in writing, by email or by telephone, stating their name, the appointment date and the time.
Appointments may be rescheduled up to 3 (three) hours before the scheduled time; however, the counsellor should also be informed of any impediment as early as possible. If more than 3 (three) appointment reschedulings occur, the counsellor reserves the right to terminate the agreement with the client.
Section 7 -- Confidentiality
The counsellor undertakes to maintain confidentiality with respect to third parties. The duty of confidentiality begins from the first point of contact. Information may only be disclosed to third parties, including a partner in couples counselling, with the written consent of the client. However, the duty of confidentiality does not extend to situations in which suspected criminal offences must be prevented or prosecuted, or where the protection of overriding legal interests is at stake. The duty of confidentiality does not include the right to refuse to give evidence that would apply in the context of psychotherapy or medical treatment.
If suicidal actions are announced and the ability or willingness to contact a specialist, therapist or clinic is lacking, the counsellor will immediately involve the relevant authorities in order to ensure the safety of the client as far as possible and to prevent any potential danger.
Section 8 -- Health Status and Concurrent Psychotherapy
The client confirms that they do not suffer from any illness or condition that impairs their legal capacity or that would preclude counselling for medical-psychological reasons at the present time.
If the client is currently undergoing psychotherapy or has been recommended to do so, this must be disclosed to the counsellor without delay. The client shall keep the psychotherapist continuously informed about the counselling (type, topics, goals, etc.). If the psychotherapist does not consent to the counselling, the counselling will be discontinued immediately.
Section 9 -- Exclusion from Counselling
If the counsellor forms the impression during a session that the client is exhibiting psychiatric symptoms or is in a state of confusion, the session may be terminated, with the recommendation that the client seek appropriate treatment.
Similarly, clients who are under the influence of drugs and/or whose enquiries relate to criminal offences may be refused by the counsellor, and the session will consequently be terminated.
Section 10 -- Documentation and Data Protection
The counsellor documents and archives the course and relevant findings of the counselling sessions, including the intake form, topic-specific questionnaires and notes on the content, outcomes and agreements of all sessions. In addition, the client's personal data is stored to the extent necessary for invoicing, service provision and accounting purposes. This personal data includes first name, surname, telephone number, email address, postal address, billing address, payment method, payment details and bank account information.
The client consents to the collection and archiving of this data.
Section 11 -- Jurisdiction, Liability and Personal Responsibility
The place of jurisdiction is 60487 Frankfurt.
Sally Schulze (counsellor) shall be liable to the client only up to the amount of the counselling fee paid for any damages alleged or actually arising from the collaborative work.
The client acknowledges that they are fully responsible for their own physical and mental health throughout the entire counselling process, both during individual sessions and in the periods between sessions. The client acknowledges that all steps and measures undertaken in the context of the counselling sessions are solely within their own area of responsibility. The client undertakes to inform Ms Schulze of any actions with far-reaching consequences and to discuss these in advance.
Section 12 -- Severability Clause
Should any provision of this agreement be or become invalid, the remainder of the agreement shall remain in full force and effect.
